Part A — Website terms

These terms govern your use of giveusabreak.me. Part B below contains the additional terms that apply to The Give Us A Break Weekly Lottery. By using this website you accept Part A; by entering the lottery you also accept Part B.

1. Acceptance and who we are

This website is operated by Give Us A Break, a registered charity in England and Wales (charity no. 1169333), whose registered office is at Unit 4, The Old Print Works, 58 Marsh Lane, Leeds LS9 8AF. You can contact us at hello@giveusabreak.me. By accessing or using this website you agree to be bound by these terms. If you do not agree with any part of them, please do not use the website.

2. Changes to these terms

We may update these terms from time to time — for example when the law changes, when our lottery arrangements change, or when we add new features to the website. The current version will always be published on this page with its effective date. Material changes to the lottery terms will be notified to active subscribers by email before they take effect. Continued use of the website after a change takes effect constitutes acceptance of the updated terms.

3. Permitted use and restrictions

You may use this website for personal, non-commercial purposes: reading about our work, entering the lottery (if eligible), donating and contacting us. You must not: use the website in any way that breaks the law; attempt to gain unauthorised access to any part of it or its underlying systems; scrape, harvest or bulk-download content or personal data; introduce malware or interfere with the website’s operation; or impersonate the charity or any other person. We may suspend or withdraw access to all or part of the website where we reasonably believe these restrictions have been breached.

4. Intellectual property

The content of this website — text, page designs, graphics and the Give Us A Break name and wordmark — is owned by or licensed to Give Us A Break and is protected by copyright and trade mark law. You may print or download extracts for personal use and may share links to our pages. Any other reproduction or reuse, including commercial use, requires our prior written permission.

5. Accuracy of information

We take care to keep the information on this website accurate and current, but figures such as prize amounts, odds, draw schedules, impact statistics and allocation percentages may be updated from time to time. Where these terms or the published lottery rules conflict with anything shown elsewhere on the website, these terms and the published rules prevail.

6. Third-party links

This website links to third-party sites — for example gambling support organisations, the Charity Commission and the Fundraising Regulator. Those links are provided for information only; we do not control those sites and are not responsible for their content or availability.

7. Disclaimers and limitation of liability

The website is provided “as is” and we do not guarantee that it will always be available or error-free. To the fullest extent permitted by law, we exclude liability for any loss or damage arising from use of, or inability to use, this website, except that nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded. Nothing in this section affects your statutory rights as a consumer or your rights under the lottery terms in Part B.

8. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute arising from them — although if you live in Scotland or Northern Ireland you may also bring proceedings in your local courts where the law allows.

Part B — Lottery terms

These additional terms apply to The Give Us A Break Weekly Lottery (“the lottery”). Please read them before entering.

B1. Eligibility

The lottery is open only to individuals aged 18 or over who are resident in the United Kingdom. You confirm both when entering, and we verify age and identity before paying any prize. Trustees, employees, contractors involved in running the draw, and members of their households are not permitted to enter. It is an offence under the Gambling Act 2005 for anyone under 18 to enter a lottery.

B2. The promoter

The promoter is Give Us A Break, registered charity in England and Wales no. 1169333, of Unit 4, The Old Print Works, 58 Marsh Lane, Leeds LS9 8AF. The designated person responsible for the promotion is Sarah Whitmore (Head of Lotteries), of the same address. The lottery operates under a Gambling Commission society lottery operating licence (remote and non-remote), account number 000-061423-R-334912-001, and is promoted in accordance with the Gambling Act 2005 and the Gambling Commission’s Licence Conditions and Codes of Practice.

B3. Entries

Each entry costs £1.00 and consists of six numbers from 1–49, chosen by you or generated as a lucky dip. An entry is valid once payment has cleared and you have received confirmation showing your numbers, the promoter’s name, the ticket price, the responsible person or ELM, and the draw date. Entries close at 11.59pm on the Thursday before each draw; entries completed after the cut-off roll into the following draw. We may set a reasonable maximum number of entries per player per draw as a player-protection measure (currently 10).

B4. Subscriptions

A weekly subscription enters your numbers into every draw and collects payment automatically at £1.00 per entry per week. You can cancel at any time by emailing hello@giveusabreak.me; cancellation takes effect before the next draw provided we receive it by the entry cut-off, and no further payments are taken. If a subscription payment fails we will attempt to contact you; entries are not made for draws that have not been paid for, and repeated failures end the subscription.

B5. The draw

Draws take place every Friday at 8pm. Winning numbers are selected using an independently certified random number generator, with each draw supervised by two senior members of staff and the result minuted. Results are published on our winners page in a privacy-safe format as soon as reasonably practicable after each draw.

B6. Prizes and odds

The prize structure is: match all 6 numbers — £25,000 (odds 1 in 13,983,816); match 5 numbers — £1,000 (odds 1 in 55,491); match 4 numbers — £50 (odds 1 in 1,033); match 3 numbers — £5 (odds 1 in 57). The top prize is capped in line with our licence. Winners are notified directly using the contact details on their entry. Prizes must be claimed within 90 days of the draw; we verify age and identity before payment, and unclaimed prizes after the claim window are applied to the charity’s purposes. If more than one entry wins the same prize tier, the prize for that tier is shared equally between the winning entries.

B7. Void entries

An entry is void, and any prize is withheld, where the entrant was under 18 or otherwise ineligible at the time of entry (stakes are returned in the case of under-18 entries); where payment failed or was reversed; where the entry was received after the cut-off and not rolled into a later draw; or where the entry duplicates another in breach of the entry limit. We may also void entries reasonably suspected to be fraudulent.

B8. Self-exclusion

You may self-exclude from the lottery at any time, free of charge, for a minimum of six months. During self-exclusion we cancel active subscriptions, refuse new entries and send no marketing. B9. Where the money goes

At least 20% of the proceeds of every lottery must, by law, be applied to the purposes of the promoting society. Our allocation is 60% to respite breaks and charitable work, 25% to the prize fund and 15% to reasonable running costs.

B10. Suspension or cancellation of the lottery

If we suspend or cancel a draw — for example for technical failure, regulatory reasons or the winding down of the lottery — entries paid for that draw will either be entered into the next available draw or refunded at your choice. If the lottery closes permanently, remaining subscription balances are refunded.

B11. Complaints and disputes

Complaints go first to hello@giveusabreak.me. We acknowledge within 5 working days and aim to resolve within 20 working days. If a lottery dispute cannot be resolved between us, it may be referred free of charge to our appointed alternative dispute resolution provider, the Independent Betting Adjudication Service (IBAS). Fundraising complaints that we cannot resolve may be escalated to the Fundraising Regulator — see our contact page.

B12. Data protection

We process entrants’ personal data — including age-verification data, payment records and self-exclusion records — as described in our privacy policy, which forms part of these terms.
